CNN.com - Groups fail to block same-sex marriage licenses - Feb. 13, 2004
Because of the decision in Massachusettes and the actions in San Francisco, gay marriage in this country is now only a legal formality. Here's why:
It cannot be denied in any court that these couples were legally married.
All it is going to take is for one couple to have their union challenged, and I don't see any way the Supreme Court, where this will inevitably end up, can deny that what they did was legal, and their union should stand. Any discrimination against future couples who request the same union will be shot down.
For all the talk about putting a constitutional amendment in place, the unions in place cannot now legally be denied. Is it possible then for a constitutional amendment (which I can't believe would pass) to be unconstitutional?
